What if my situation does not exactly match the statutory requirements?
The expungement statute was amended in 2009, effective July 1, 2009, to increase the age limit to twenty-five and, for the first time, it permitted Class H and I felonies to be expunged. Thus, people whose conviction occurred prior to July 1, 2009, are not clearly entitled to expungement. Does this mean that they are out of luck?
Initially, it was thought that the amendments to the expugement law did, in fact, apply retroactively. Some courts did apply it retroactively. However, recently, in State v. Meinhardt, 2012 Wis. App 82, the Wisconsin Court of Appeals held that the 2009 amendments may not be applied retroactively to convictions that occurred prior to July 1, 2009.
